General conditions of sale
Neal Morgan Photography
All photo shoots carried out with Neal Morgan Photography imply that the customer has read and accepted these general conditions of sale. Full terms and conditions are at https://www.nealmorgan.be/terms-and-conditions
The photographer reserves the right to modify them at any time. The conditions thus modified will apply to any order placed after the modification date, including any additional order.
1. Object
Neal Morgan Photography offers photographic services as presented on his website: www.nealmorgan.be
2. Reservation
The reservation of a photographic service is made by phone at 0456.04.19.57 or by e-mail: info@nealmorgan.be according to the contact information provided on the website: www.nealmorgan.be. The reservation will not be final only upon receipt of the confirmation email.
3. Prices
Prices are indicated in euros, all taxes included. If these are likely to be modified at any time and without notice, any appointment made in advance will keep the rate applied at the time of booking. Neal Morgan Photography is under the Régime spécial d’exception pour les petites entreprises for TVA in Belgium.
For outdoor sessions, travel expenses are included within the limit of 30km (the round trip must not exceed 30km) from the photographer’s home (Tubize, Belgium).
4. Payment
Payment can be made in cash or by bank transfer. Cash payments are made on the day of the session before work commences at the latest. For transfers, the amount must be paid into the company’s bank account within 5 days of the date of the appointment being made.
Following the session, the client can order various media (prints, albums, enlargements, etc.). These media must be paid for before production when the order is taken and are non-refundable since are unique to you. The client is to come and collect these in person at the studio.
5. Delivery of photos
The photos are delivered on average two to six weeks after the selection and validation of these by the customer in a private online gallery. This deadline is given as an indication and may change depending on the photographer’s workload. The photos are sent in JPG format, by email or via a download link. No raw photos (RAW) will be given to the customer, cannot be demanded, and the photographer reserves the right to destroy them within the time that suits them.
6. Retouching
The photos are carefully retouched before being delivered according to the artistic sensibility of the photographer. The post-processing carried out on them is an integral part of the work, the client holds no right to reject on the basis of style or composition.
Any additional retouching requested by the client will be accepted or not by the photographer who reserves the right to invoice the additional work per image according to the rates in force.
7. Archiving
The photos are kept for one year from the date of the session. However, the photographer cannot be held responsible for a computer crash, theft or any other event resulting in the loss of photos during this period. The customer is invited to carry out digital archives himself in
several copies of the photos received.
8. Copyrights
The copyrights and intellectual property on the photographs taken remain entirely the property of Neal Morgan Photography. The photographs are taken for strictly private use. Any commercial use is prohibited without the prior written permission of the photographer. Useage fees will be levied in any case of copyright infringement.
The customer agrees not to retouch or modify in any way the photos provided to him if he disseminates them on the internet. It should also include the copyright notice in the description: @Neal Morgan Photography
9. Image rights
The photographer reserves the right to use the photographs he has taken for self-advertising purposes in the context of the promotion of his activity (website, social networks, exhibitions, etc.). If the client does not want the photographer to use their image, they must notify them in writing before the session, when booking.
10. Personal data
The personal information collected during the placing of an order is intended exclusively for the management of the customers and in particular the follow-up of the reservations for the good realization of the ordered service. The photographer undertakes not to communicate this information to third parties for any reason whatsoever.
11. Postponement I Cancellation
11.1 Weather conditions
In the event of weather conditions making it impossible to carry out an outdoor session, the date of the session will be postponed once. If for the same reasons during the second meeting the session cannot be done, we will reschedule again.
11.2 Force majeure
The photographer reserves the right to cancel a photographic service in the event of force majeure. Such cancellation can neither engage its liability nor give rise to the payment of damages for any reason whatsoever.
11.3 Technical problem and accident
The photos are taken with professional equipment. However, if these were to be lost, stolen or destroyed before being able to be delivered to the client, a new session will be rescheduled as soon as possible. If this is not possible, the amounts collected under this agreement will be reimbursed, without giving rise to the payment of damages for any reason whatsoever.
12. Responsibility
Children and guests present during the photoshoots remain under the full responsibility of the client. In the event of material damage caused by the client or the persons accompanying them, the client will be responsible for replacing (like for like) or reimbursing the damaged material in full.
Neal Morgan Photography reserves the right to not be physically or verbally abused at any time during the photoshoot, abuse will result in the session being cut short with no refund offered.
13. Applicable law
These general conditions are governed by Belgian law. Any dispute relating to the formation, execution, or interpretation of these general conditions as well as any agreements to which they apply, will, in the absence of an amicable agreement prior to the conclusion of the contract, be subject to the exclusive jurisdiction of the Belgian courts and more particularly of the courts of Brussels.
